These Terms & Conditions (“Terms”) govern your use of the website at groundworkidaho.net (the “Site”), operated by Groundworks Excavation & Construction (“Groundworks,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. About our services
Groundworks is an excavation, grading, site prep, and concrete contractor serving the Treasure Valley, Idaho. The Site describes our services and lets you request a free quote. The Site itself is informational; any work we perform for you is governed by a separate written estimate or contract between us and you. Nothing on the Site is a binding offer, a firm price, or a guarantee of any specific result or schedule.
2. Use of the Site
You agree to use the Site only for lawful purposes. You will not:
- Use the Site in any way that violates applicable law or regulation
- Attempt to gain unauthorized access to the Site, our host, or any connected systems
- Interfere with or disrupt the Site’s operation or security
- Submit false, misleading, or malicious information through our forms
- Use automated means to scrape, copy, or misuse the Site or its content
3. Quote requests and communications
When you submit our quote form, you confirm that the information you provide is accurate and that you have the right to share it — including that you are the account holder of, or are authorized to use, any phone number you give us. Submitting the form does not create a contract or guarantee a response, a price, or any particular timeline. Quotes are estimates based on the information available and may change once we see the site. Your submissions are handled in accordance with our Privacy Policy.
4. Intellectual property
The Site and its content — including text, photographs of our work, graphics, logos, the Groundworks name and badge mark, layout, and code — are owned by Groundworks or its licensors and are protected by intellectual-property laws. You may view and share the Site for personal, non-commercial purposes, but you may not copy, reproduce, modify, distribute, or create derivative works from it without our prior written permission.
5. Third-party links and services
The Site relies on third-party tools and services (for example our web host, Google Workspace, and our messaging provider Twilio). We are not responsible for the content, policies, or practices of any third party. Your use of a third party’s services is subject to that party’s own terms.
6. Disclaimer of warranties
The Site is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any information on it is complete or current. Warranties on work we actually perform are covered by your written estimate or contract, not by these Terms.
7. Limitation of liability
To the fullest extent permitted by law, Groundworks and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) the Site. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).
8. Indemnification
You agree to indemnify and hold harmless Groundworks and its owners from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your misuse of the Site or your violation of these Terms.
9. Changes to the Site and these Terms
We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time; when we do, we will revise the “Last updated” date above. Your continued use of the Site after changes take effect means you accept the revised Terms.
10. SMS / text messaging terms
These SMS terms apply if you opt in to receive text messages from Groundworks Excavation & Construction — including through the SMS consent checkbox on our quote form, our text-message opt-in form, verbally over the phone, or by texting us first. By opting in, you agree to the following:
- Program. Groundworks Excavation & Construction sends recurring automated text messages related to your project — quote follow-ups, appointment and crew-arrival reminders, job and schedule updates, and occasional service offers.
- Consent. You agree to receive these messages at the mobile number you provide, and you confirm you are the account holder or have authorization to use that number. Consent is not a condition of any purchase and is not required to get a quote or hire us.
- Message frequency. Message frequency varies based on your project and your interaction with us.
- Cost. Message and data rates may apply, according to your mobile plan. Contact your wireless provider for details.
- Opt in. You can opt in by checking the SMS consent box on our quote form, by submitting our text-message opt-in form, or by texting START to our messaging number. Texting START confirms your consent to receive (or resume receiving) messages from us.
- Opt out. You can cancel at any time by replying STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT) to any message. After you send STOP, we will send one confirmation message and then stop texting you. To opt back in, submit the opt-in form again or reply START.

- Supported carriers. Message delivery is supported on major U.S. carriers. Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your wireless carrier and is not guaranteed.

11. Governing law
These Terms are governed by the laws of the State of Idaho, USA, without regard to its conflict-of-laws rules. Any dispute relating to the Site or these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Idaho.
